EVRIS has completed financial restructuring for PJSC Alfa-Bank

EVRIS law firm has completed the project on provision of legal support for PJSC Alfa-Bank in the process of financial restructuring of a debt of nearly USD 100 million. The project is the largest in terms of debt volume, which has been restructured, among all the procedures carried out in accordance with the new Law of Ukraine On Financial Restructuring.

The firm’s team responsible for the project consisted of Kateryna Breduliak, associate, and Sergii Papernyk, head of Banking and Finance practice.

Dentons advised FUIB on loan restructuring

 Dentons acted as Ukrainian and English legal counsel to First Ukrainian International Bank (FUIB) in connection with the restructuring of
UAH 672 million loan to a Ukrainian company. Dentons’ lawyers provided complex legal support on a foreign law governed guarantee.

Dentons Kiev team was led by partner Natalia Selyakova with significant input from associate Nadiya Shylienkova.

 

AVELLUM — Ukrainian legal advisor to Deere & Company

AVELLUM acted as the Ukrainian legal advisor to Deere & Company on Ukrainian employment matters related to the USD 5.2 billion acquisition of the Wirtgen Group.

AVELLUM advised on retention of employees of a Ukrainian subsidiary of the Wirtgen Group and also provided ancillary advice on Ukrainian employment law.

Deere announced its acquisition of the Wirtgen Group in December 2017. The Wirtgen Group is a leading manufacturer of road construction equipment headquartered in Germany.

The AVELLUM team involved in the transaction was led by the managing partner Mykola Stetsenko, with support from associates Andrii Gumenchuk and Sofiia Kostytska.

AEQUO advised JSCB  Industrialbank 

AEQUO advised JSCB Industrialbank in the course of restructuring of a USD 19.7 million debt under the syndicated loan granted to the Ukrainian borrower Mercury LLC and secured by the mortgage of Kiev Hotel Khreschatyk.

It was the first-ever financial restructuring under the Law On Financial Restructuring involving multiple creditors: JSCB Industrialbank, JSC Express-Bank and financial company Capital Express LLC.

AEQUO project team included Valeriy Savva, associate and was supervised by Yulia Kyrpa, partner, head of Banking and Finance practice.

Asters advised International Finance Corporation

Asters acted as a Ukrainian law counsel to International Finance Corporation (IFC), a member of the World Bank Group, in connection with a loan of over EUR 30 million to IMMER Group, a leading Eastern European producer of flexible packaging.

IFC’s financing package, which includes EUR 15 million in debt mobilized from other lenders, is designed to support growth of IMMER Ukrplastic, Ukraine’s largest manufacturer of flexible packaging materials.

Asters’ banking and finance team advising on the project consisted of partner Iryna Pokanay, counsel Gabriel Aslanian and associate Inna Bondarenko.

Kinstellar — Ukrainian legal counsel to ArcelorMittal Kryvyi Rih

Kinstellar acted as Ukrainian legal counsel to PJSC ArcelorMittal Kryvyi Rih in connection with a USD 350 million loan facility provided by the European Bank for Reconstruction and Development (EBRD).

The loan to ArcelorMittal Kryvyi Rih will enable the company to modernise its facilities for sintering and to reline one of the plant’s blast furnaces.

The loan facility has been structured as an A-loan of up to USD 200 million to be provided by the EBRD and a B-loan of up to USD 150 million that will be syndicated to commercial banks.

Kinstellar’s team advising on the transaction was led by Andriy Nikiforov, counsel, and included Serhiy Mykhaylyk and Yulia Eismont, associates.
