Doubinsky & Osharova defended Tiffany & Company

The District Court of Odessa Region adopted a decision in the case of violation of intellectual property rights to the trademarks of Tiffany & Company.

The specified criminal proceedings were instituted on the basis of statements made by representatives of the patent and law agency Doubinsky & Osharova. Thus, lawyers drew the attention of law-enforcement authorities to illegal activity on the Internet website cbrand.com.ua, where counterfeit/ fraudulent goods illegally labeled trademarks of Tiffany & Company were offered for sale. Accompanying criminal proceedings at all stages the attorneys of the agency managed to stop completely illegal activities on the site www.cbrand.com.ua, and the owner was brought to trial.

The client’s interests were represented by partner Yaroslav Ognevyuk and the agency’s attorney, Dmytro Nikulesko.

FCLEX defended Bilanivskyy Mining and Processing Plant

The law firm FCLEX has successfully represented Bilanivskyy Mining and Processing Plant in Komsomolsk City Court in Poltava Region in a dispute with Kremenchuk District Council. The topic of the trial was the decision of the local district administration, which in fact prohibited development of Bilanivskyy ferruginous quartzite deposits. The dispute followed the events of June 2013 when Kremenchuk District Council approved the planning scheme for Kremenchug district, which provided for construction of a new mining and processing plant.

However, in February 2014 the new leaders of the district council decided to impose a moratorium on the plan in terms of construction of the Bilanivskyy Mining and Processing Plant. In July 2014 the company appealed to a court to invalidate such decisions by the local authorities. The trial lasted more than six months and, as a result, the court adopted a decision that granted the claim made by the company. Partner Vyacheslav Krahlevych represents the plant in courts.

 

Doubinsky & Osharova defended Inkerman

The patent and law agency Doubinsky & Osharova successfully defended the interests of the known wine-making group of company from Crimea in litigation about invalidation of the trademarks Inkerman Sunset and Sunset of Inkerman. The Kiev Commercial Court decided to satisfy the claim of the agency’s client for partial invalidation of certificates of Ukraine on trademarks due to their similarity to the earlier registered trademark Inkerman. Representing the plaintiff’s interests the attorneys of the agency proved to the court that the disputed trademarks didn’t correspond with the terms of legal protection.
