Doubinsky & Osharova defended McDonald’s right to well-known trademark

On 20 August 2019, the Supreme Court put an end to the economic dispute and upheld the decision of the Appeal Chamber of the State Intellectual Property Service of Ukraine on the well-known status of the “Mc” trademark in Ukraine and the compliance of this mark with all factors of the well-known trademark. It should be noted that in Ukraine the “Mc” trademark has created a large trademark family. It was the intensity of its use and recognition that made it possible to receive the status of a well-known trademark.

McDonald's considers its family of Mc-prefixed trademarks to be among its most valuable assets as customers throughout the world immediately recognize these trademarks as being associated with great quality food offered by McDonald's.

McDonald’s interests in the courts were represented by Doubinsky & Osharova team under the leadership of partner Anton Koval.
