KPMG Law Ukraine defended interests of a major Ukrainian publishing house

KPMG Law Ukraine team represented interests of a subsidiary of a major German media corporation in a dispute with tax authorities regarding correctness of registration amount in VAT Electronic Administration System (VAT EAS) account.

The lawyers of Tax Dispute Resolution team proved, at the appeal stage, that the Company lawfully charged negative VAT amount to increase the registration amount in its VAT EAS account. In the course of the trial, it was substantiated that tax authorities’ refusal to take into account adjustments to VAT declaration was unlawful and contradicted tax legislation. As a result, the Court of Appeal ordered the State Fiscal Service of Ukraine to increase the registration amount in Company's VAT EAS account, thus enabling to protect the Company's property rights.

The engagement was performed under the leadership of Kostiantyn Karpushyn, partner, head of Transfer Pricing and Tax Dispute Resolution Group, Larysa Antoshchuk, attorney, head of Tax Dispute Resolution Practice. Iryna Khyliak, Yana Bazia, and Vladyslav Kepko, lawyers, were also involved in the engagement.
